Institutional Sex Abuse Lawsuit

Claims alleging acts of sexual abuse against individuals within the confines of prominent institutions across the United States are mounting at an alarming rate. Institutional sexual abuse occurs when an employee or agent of an institution sexually assaults a student, patient, resident, detainee or inmate. These acts can involve sexual violence, rape, inappropriate sexual comments, indecent exposure or the unwanted sharing of sexual content (e.g. photos, videos, emails, and texts).

Abusers within institutions are usually in positions of power and authority—such as professors, physicians, and clergy members. The respect that often accompanies these positions is used against the victim by the abuser to betray and manipulate them.

Statute of Limitations on Holding the Institution Accountable

1. Each state has its own time limits when it comes to filing a sex abuse lawsuit and holding an institution accountable for its role in the abuse. Each case will be evaluated accordingly.

Criteria:

The person must have been abused

1. Qualifying Physical Abuse:
  • a. Rape or statutory rape
  • b. Attempted rape or attempted statutory rape
  • c. Sexual assault
  1. i. Manual stimulation
  2. ii. Oral copulation
  3. iii. Digital penetration
  4. iv. Touching or kissing of sexual body part, may be over or under clothing
  5. v. Sexual trafficking
  6. vi. Meeting in person with intent of assault, whether child is physically or sexually assaulted or not. such as indecent exposure
2. Qualifying Virtual Abuse
  • a. Sextortion/person sent explicit materials
  1. i. Photos, videos, website involving nudity
  2. ii. Monetary exchanges
  3. iii. Attempted Sextortion or child received sexually explicit materials.
  1. 1. injured was asked to send photos of themselves, asked to send money or another form of payment and/or threatened
  2. 2. Child received sexually explicit images or other material from abuser
  3. 3. Abuser must have engaged in multiple inappropriate communications with the child
  4. 4. Must also have a qualifying injury
  • b. Grooming
  1. i. Adult abuser engaged in grooming with child
  1. 1. Grooming is where the abuser builds a relationship with the client or manipulates the child for the purpose of sexually exploiting or abusing the child.
  1. ii. Abuser must have engaged in multiple inappropriate communications with the child
  2. iii. Must also have a qualifying injury
3. Injury: If qualifying abuse is in person meeting without physical sexual assault, attempted sextortion/child received sexually explicit materials or grooming, must also confirm one of the following injuries
  • a. Statutory Rape, Rape, Attempted Statutory Rape, or Attempted Rape
  • b. Sex Trafficking
  • c. Other Physical Sexual Assault (forced manual stimulation, oral copulation, digital penetration or non consensual touching or kissing of a sexual body part)
  • d. Sent or received sexually explicit materials
  • e. Injured diagnosed by a healthcare professional with depression, anxiety, PTSD or suicidal ideation as a result of abuse.
  • f. Injured sought medical attention for physical harm experienced as a regular of the abuse. Medical diagnosis of injury must be made after abuse began unless the guardian or victim can articulate physical or emotional changes since the abuse that have impacted the life of the abused (School issues, etc)
  • g. Injured attempted or died by suicide as a result of the abuse.
  • h. Injured sought and/or is actively seeking psychiatric or psychological treatment as a result of abuse – including treatment for substance abuse or self harm.
  • i. Official school records document mental health or behavioral issues that Injured experiencing as a result of the abuse.
  • j. Guardian or victim can articulate physical or emotional changes since the abuse that have impacted life.
